Personal Injury - important cases resolved include:
• FBI Agent in a cross walk and hit by a car. At trial in 2006, a jury awarded the Agent a paultry $42,000. We appealed the case, fronted all of the expenses and had the verdict overturned due to the defense attorney's improper conduct during trial. At the second trial we obtained more than 10 times what the first jury awarded: $450,000.
• Young woman driving on Parkway hit by car making a left hand turn, without yielding, causing comminuted fractures, and many "open reduction" operations to repair the fractures: $750,000.
• We resolved 31 personal injury/malpractice cases to the satisfaction of our clients.
Medical Malpractice - sample cases resolved, in difficult (conservative) counties, include:
• Failure to diagnose cancer in Ulster County. Doctor knew a 66 year old patient had a polyp and properly went in to biopsy it, but the procedure failed and the doctor just decided to "monitor" the polyp for 2 years instead of trying to biopsy or remove the polyp as initially intended: $550,000.
• Failure to Diagnose Bowel Perforation in Orange County: 72 year old woman, with many pre-existing health conditions, went to a Hospital as a result of being given too much Lasix, causing dehydration and life threatening low potassium. 10 hours of pain and cardiac arrest: $350,000.
• Improper neck surgery and broken screws not fixed in Westchester County: Neurosurgeon performed surgical disc removal surgery, fused two vertebra, and used screws to hold them in place. At the deposition, Anthony had the Doctor admit that there was micro motion in the screws, and the screws later broke as a result, causing the screws to be replaced: $350,000.

Medical Malpractice - some cases resolved include:
• Failure to diagnose autoimmune disease, Wegener’s Granulomatosis. Doctor failed to understand significance of elevated creatinine, BUN and potassium along with blood/protein in urine, causing hypokalemia and kidney damage: $775,000.
• Improper surgery/insertion of urethral “sling” causing urinary incontinence. During the trial, Anthony proved that the Doctor altered the chart three times, and that he twice installed the sling contrary to the manufacturer’s instructions: $625,000.
• Improper surgery/implantation of hip replacement. Anthony had the Doctor admit that the femoral head, as it met the acetabular cup, was loose intra-operatively, and that the femoral head later slipped out hitting the peroneal nerve causing foot drop: $550,000.
Personal Injury - some cases resolved include:
• 26 year old, disabled, leukemia survivor fell out of wheelchair while being transported because she was not properly buckled, resulting in fractures of both femurs. Our world renown expert concluded that a $100 buckle would have prevented the accident. $625,000.
• Motorcyclist was struck by vehicle that backed out of driveway at direction of driver’s relative, fracturing the motorcyclist’s leg, necessitating multiple surgeries: $525,000.
• Woman struck by vehicle backing the wrong way on one-way street aggravated pre-existing condition requiring surgery: $475,000.

Accomplishments
• A Statewide Panel of Super Lawyers elected Anthony a member - top 5% of Lawyers in the "Metropolitan Area" of New York State in personal injury, as reported in the New York Times Magazine and Westchester Magazine (there are 120,100 lawyers in the "Metropolitan Area").
• Anthony's overall success for his clients in their Personal Injury, Products Liability and Medical Malpractice cases continues to be better than 95% for the last 17 years.
• Since June 30, 2003, Pirrotti Law Firm LLC earned for its clients and their families more than $18,305,000 in client approved settlements and jury verdicts, increasing Anthony's client earnings to over $40,000,000.
Medical Malpractice - cases resolved include:
• anesthesia error during surgery resulting in death;
• failure to diagnose and repair a perforated colon resulting in death;
• error during unnecessary therapeutic procedure resulting in death;
• misdiagnosis of tuberculosis resulting in death;
• delayed diagnosis of cancer resulting in perforated colon and surgery; and
• failing to maintain safety of hospital patient resulting in a fall and fracture.
Personal Injury - cases resolved include: rear end accidents; head on collisions; pedestrian knockdown; roadway defects; slip and fall down stairs; improper clearance of snow/ice; slippery surfaces; and a defective coffee machine. The injuries sustained in these cases included: death, fractured bones, herniations, torn ligaments, burns, hip replacement and surgical repairs of disc and ligament injuries.
Contract Litigation and Sales/Purchases - closed or successfully terminated approximately $7,400,000 in real estate transactions and sales/purchases of businesses (restaurants, dry cleaners and a café).
Criminal - misdemeanor charge dismissed after trial; suppression hearing conducted for gun possession; and DWI charges reduced.
Currently - litigating cases involving: improper surgery resulting in quadriplegia; construction site accident resulting in quadriplegia; death of 26 year old in van accident; misdiagnosis of cancer; defective prosthesis; defective medical device; delayed medical diagnoses resulting in serious injuries/death; medical malpractice resulting in bladder incontinence; improper drug prescription and dispensing; nursing home mistreatment; motor vehicle accidents; and hazardous premises conditions.
We have an overall 97% success rate in personal injury, medical malpractice and products liability cases. Since June of 2003, our firm obtained jury verdicts and settlements for our clients totaling over $13,809,000.00. This summer Anthony worked 5 weeks straight, 6-7 days a week, sometimes 16 hours a day, in order to achieve successful results on 4 separate cases that went to trial. In the past ten years alone, Anthony has personally secured more than $32,750,000.00 in jury verdicts and settlements for his clients.
On "motions" submitted/argued to the Supreme Courts, our firm's success rate is better than 85%. In each case, a "motion" usually has to be made to the presiding Judge concerning a disputed issue of law. Obviously, it is important to win as many motions as possible! Adam's case preparation, unique ability to research prevailing case law and ability to write persuasive motions is integral to our success rate.
In two years alone, our firm closed more than $14,810,000.00 in purchases/sales of residences and businesses. In the past year, we handled the purchase of a doctor's medical practice, sale of a restaurant and sale of a beauty salon. We went to trial and prevented the eviction of an established business and also won a breach of contract bench trial. Anthony taught a "Trial Practice" class at Pace University Law School, and lectured parents on DWI and Homeowner's Liability at Ardsley Middle School. Additionally, we successfully litigated criminal cases concerning DWI, Arson, Assault and Menacing.
Statistics June 2003-2004
Personal Injury cases concerned: a 57 year old carpenter who fell from a scaffold on a construction site, was severely injured and was unable to return to work. For this client, Anthony procured a $900,000.00 settlement on the eve of trial.
Car/Truck/Motorcycle accident cases concerned a pedestrian knockdown, hits in rear and broadside accidents resulting in surgery on hips, femurs, herniated discs, tears of the
meniscus, etc. Slip and fall cases involved similar injuries and great results were obtained for our clients despite difficult liability.
We are currently litigating brain injury cases amongst dozens of other serious bodily injury cases, including cases for Libel/Defamation and Products Liability. Our practice is limited to litigation involving significant injuries and loss.
Teaching Law and Lecturing
Anthony was honored to teach two trial practice classes at Pace University School of Law and lectured at the Ardsley High School symposium concerning DWI/Drug prevention.
Breach of Contract/Collection/Trespass
In addition to recovering money for our clients to compensate them for their injuries and loss, our firm saved our clients hundreds of thousands of dollars by successfully defending/ prosecuting cases, negotiating liens and preparing settlement agreements.
Estate Litigation
After 3 combative days of trial and eliciting testimony from 6 witnesses, Anthony was successful in obtaining a favorable 16 page decision from the Surrogate's Court disallowing a father's right to his 50% statutory share of his deceased daughter's inheritance as a result of his abandonment and physical abuse of her. We also successfully culminated Federal Court ERISA litigation in which a deceased husband tried to disinherit his surviving wife's interest in his pension plan.
Real Estate/Commercial Leasing/Sale of Businesses
Anthony also negotiated Commercial lease agreements and handled lease disputes for a well known Golf Shop and Restaurant. We also handled the sale of a Hair Salon and a Pizzeria, as well as prepared Shareholder's Agreements for prominent Construction Companies and a prestigious Jewelry Store.
Criminal
Anthony successfully defended two clients in criminal cases which went to trial and verdict concerning Assault and Menacing Charges. He successfully prevented the revocation of our client's driver's license after a DMV hearing and had a DWI charge dismissed in Bronx County as a result of a successful Omnibus motion.
He negotiated plea agreements resulting in reduced charges for numerous clients concerning misdemeanor and felony charges of DWI, larceny/theft, drug possession, etc.
Motions
While the above excellent results are in large part due to Anthony's success as a trial attorney/litigator, they are also due to the firm's very high success rate (over 85%) on motions decided by Judges as a matter of law. Adam is intricately involved in researching and preparing motions concerning all aspects of litigation. The decision on one of
the firm's motions was of such importance that it made the front page of the New York Law Journal, on July 14, 2003, and was a case of first impression in the State of New York. Another important case made the front page of the New York Law Journal "Decisions of the Day" on August 27, 2004, in which Anthony was successful in disallowing a father's right to his 50% statutory share of his deceased daughter's inheritance as a result of his
abandonment and physical abuse of her.
Statistics 1998-2003
From 2001 through June 2003 Anthony achieved $5,735,212.00 in settlements and jury verdicts for his clients concerning medical malpractice, personal injury, products liability and estate cases. Anthony also went to verdict on a criminal trial and was successful in proving his client's innocence. Numerous DWI, assault, and drug possession cases were also successfully defended. Anthony, and our senior associate, Adam, along with our legal
staff, work together to bring about these excellent results.
In the year 2000, Anthony litigated various cases which paid $1,932,779.00 for his clients. These complex cases concerned medical malpractice in causing the tragic death of his client by failing to stop internal hemorrhaging during childbirth; medical malpractice by the improper removal of a galactocele in his client's breast; negligence through improper lowering of a mammography machine resulting in internal damage to his client's knee; wrongful
death of his client who was killed by a truck; numerous hit in the rear cases involving back and neck injuries; car accident causing his client to sustain orbital and ulnar fractures; wrongful death of our client by a fall from an apartment landing; and wrongful death of our client by a falling dead tree limb.
In 1999, Anthony earned settlements and verdicts for his clients totaling $6,608,500.00. Anthony achieved a $3,500,000.00 verdict against an attorney for legal malpractice. After a six-day trial, Anthony won an $800,000.00 unanimous jury verdict (reduced partially due to plaintiff's comparative negligence) against a landlord who caused our client to sustain second/third degree burns over her lower body. Anthony also achieved an $800,000.00
settlement for our client who was injured as a result of improperly placed metal plates on a roadway. Anthony negotiated a $180,000 settlement of a complex laparoscopic surgery case against a physician who perforated our client's intestine. He also settled a sex discrimination suit in Federal Court for a female client for $100,000.00 and a difficult case of age discrimination for a male client for $54,000.00. Anthony represented an 85 year old woman who sustained a fractured hip and arm requiring surgery, as a result of a faulty automatic door closing on her, which resulted in a $115,000 settlement. In various car accident cases causing bulging/herniated discs, he achieved awards totaling $277,000.
In 1998 the total verdicts and settlements achieved by Anthony for his clients was $1,664,238.00. Anthony won a significant medical malpractice jury verdict concerning a doctor who negligently performed laparoscopic surgery lacerating his client's bile duct. During this nine day trial in Poughkeepsie (a very conservative county), there was never an offer to settle by the doctor's insurance company. Anthony achieved a $469,738.00 unanimous jury verdict for his client! One month later, Anthony also won a unanimous jury's liability verdict on an automobile case in which our client sustained a bulging/herniated degenerative disc. After summations, the case settled for $75,000.00. Another personal injury case was settled by Anthony for $250,000.00 when his client sustained a fractured scapula and aggravation of a pre-existing back condition. Anthony settled a torn meniscus cartilage case for $95,000.00 prior to jury selection and also achieved a settlement for an attorney's malpractice in failing to file an action for our client, who fractured her coccyx ($50,000.00). He settled a half dozen other age discrimination and injury cases for his clients for an additional $724,500.00.
In 1997 Anthony achieved over Three Million ($3,000,000.00) Dollars in settlements and awards for his clients. Most cases concerned catastrophic injuries; two resulted, tragically, in the death of our clients. Some of the cases were printed in the New York Jury Verdict Reporter. One medical malpractice action involved the delay of five doctors and an HMO to diagnose cancer of our client and friend, Marie. After three years of litigation and preparing this case for trial, Anthony resolved the action for half of a million dollars prior to jury selection. A non-disclosure agreement was entered into and, therefore, the case was not reported.
The second major trial of the Summer of 1997 concerned his client and friend, Pietro, who fell 20 feet off a scaffold due to a safety bar that gave way. After five years of litigation in Bronx County, three days of jury selection and prior to opening statements to the jury, the case was resolved for $1,100,000.00.
Anthony won a jury trial for his client, Danielle, who sustained a fractured spinous process when her car was hit in the rear by a Mack truck. The jury awarded $305,610.00. The Defendant appealed the verdict. On appeal, the damage award was affirmed (twice) by a 5 Judge panel of the second highest court in the State, the Appellate Division.
